Who pays my Personal Injury Medical Bills?

In almost every accident claim and with the ever increasing cost of health care, medical bills become a grave concern for most injured parties. Who should pay for those medical bills and deductibles and, most importantly, when?

In a typical car accident case, your automobile insurance will likely have what is called medical payments coverage. This coverage will cover the first specified dollar figure of all medical payments for any accident you were in regardless of who is at fault. After it is exhausted, your automobile insurance is typically not required to continue to cover any medical bills you incur unless you have an under or uninsured motorist claim to present your own carrier.

After medical payments coverage is exhausted, hopefully you have health insurance that will continue to pay for all necessary medical care as a result of your accident. Unfortunately, this means you must pay any deductibles and copays out of pocket until your case is resolved.

Once we prove the other driver or responsible party is at fault, he or she and his or her insurance company will be required to pay for the full cost of all medical care, including reimbursement for your out of pocket expenses. Eventually you get paid back, but the up front cost can be a giant burden on you and your family.
